1.  Takeaway Orders

1.1. Our role is limited to providing the Site for You to access information on, and place orders with Us.

1.2. Each Order placed by You through the Site represents a legally binding contract between you and Daan. The contract shall be legally binding with effect from the point at which you click "Submit Order" on the confirmation page.

1.3. Once an Order is placed by You it can be cancelled by contacting customer service (see Contact Us).

1.4. Daan has the right to cancel any Order placed by You at any time after such Order is placed at its discretion.

1.5. If We cancel any Order we shall contact You direct by e-mail or telephone to the address or number provided by You when You place the Order. There shall be no liability to offer any compensation for any disappointment or other loss suffered as a result of such cancellation.

1.6. We will deliver the Order to You at the address specified by You in Your Order. We shall use all reasonable endeavours to deliver within the time specified on the Site.

1.7 We will endeavour to deliver inside 45 minutes within a 5 mile radius, please note 45 minute delivery is not guaranteed, 45 minute delivery will be suspended in extreme weather conditions and during peek times 6pm to 9pm.

1.8 Any orders that are placed before our opening hours will be prepared and delivered within 45 minutes from the time we open on that particular day. See contact us section for trading hours.

1.9 Items and Prices for Daan deals or promotional meals are set, any changes that are made by the customer will incur a charge of minimum £1.00 per item.

1.10 We are always closed on Christmas Day and Boxing Day and some religious occasions.

1.11 Last orders should be placed 15 minutes before closing time.

1.12 Free delivery on all orders over £12.00 within MK1 to MK15 postcodes and Newport Pagnell. MK16, MK17, MK18, MK19, may be subject to a delivery charge, please inquire when placing your order.

1.13 Complaints of any nature should be made within 72 hours of receiving your order, any complaint made outside of this time will not be accommodated.

2.  Price and Payment

2.1 Unless otherwise agreed between you and us, the price for the products  shall be the price advertised on the website as published on the date of the order.

2.2 We do not except cheques or e-cheques.

2.3 Upon submitting your order details, you are making an offer to us to purchase the item(s) you have specified in your order form. We reserve the right to refuse your offer should it be necessary.

2.4 All paypal transactions will incur a surcharge of 3.0%.

2.5 All card payments over the phone will incur surcharge of £0.40p.

3. Changes To Service

We reserve the right to improve, amend, or suspend the service provided on the Site at any time without notice to You.

4. Amendments to Terms and Conditions

We reserve the right to alter these terms and conditions at any time with immediate effect by placing the amended terms and conditions on the Site.

5.Privacy

5.1 All information that you provide about yourself to us shall be used in accordance with our Privacy Policy.

5.2 You acknowledge that you have read and agree to be bound by the terms of our Privacy Policy.

6. ENTIRE AGREEMENT

6.1 These terms and conditions (as amended from time to time), together with the terms and conditions of use of the website (as amended from time to time) and the privacy policy (as amended from time to time), constitute the entire agreement between you and us. You should regularly check the terms and conditions of use of the website and the privacy policy for any updates and/or amendments.

7. GOVERNING LAW AND JURISDICTION

7.1 The agreement between you and us shall be governed by the laws of England and Wales and you and we shall both submit to the exclusive jurisdiction of the courts of England and Wales.
